The most important condition for the dissolution of marriage by mutual consent in Greece is the spouses’ agreement on custody, maintenance & communication with their minor children after divorce.

Spouses’ disputes over marital assets may be resolved before or even after the dissolution of marriage by mutual consent or adversarial divorce process. Community property may be divided either consensually or by court proceeding after the filing of lawsuit by one spouse against the other according to article No 1400 of Greek Civil Code. The lawsuit must be filed within two years either from the dissolution of the marriage or from the completion of a three-years separation of spouses during the marriage. Therefore, disputes over marital property that may arise are not an obstacle to the dissolution of marriage by mutual consent.

The procedure of mutual consent divorce can be undertaken completely by our lawyers. Spouses have the option to sign a notarial power of attorney by which they appoint our lawyers to act on their behalf all necessary actions for the dissolution of their marriage.
